The 2020 election cycle promises to be a particularly divisive and combative affair which will inevitably permeate workplaces across the country. Such divisiveness (including that created by social media platforms) inevitably exposes employers to claims of harassment, discrimination, and retaliation. Additionally, it destroys teamwork and negatively impacts productivity. This session will focus on how employers can navigate this election cycle in a manner that helps limit liability exposure, avoids the creation of unhealthy dialogue and minimizes the disruption that it might otherwise cause.
Learning Objectives:
- Learn how to minimize the upcoming 2020 election cycle’s potential legal exposure for employers to claims of harassment, discrimination, and retaliation.
- Learn how to proactively address political behavior/beliefs in the workplace and encourage healthier dialogue.
- Learn how to navigate issues related to political speech on social media and avoid workplace disruption.

Biographies:
Fred Bissinger is Regional Managing Member of the Nashville, Tennessee office of the firm, which he joined in 1999. His law practice includes an emphasis in handling employment discrimination and wrongful discharge matters at both the administrative level and in Federal and State Court litigation. His practice also includes an emphasis on ADA and FMLA compliance, as well as general liability matters. He received his Bachelor of Science, cum laude, in Economics from Washington & Lee University and his law degree from the Seton Hall University School of Law. Prior to entering private practice, Fred served in the United States Navy Judge Advocate General Corps from 1993-1997. He is a member of the Tennessee Bar Association. Fred also currently serves as the Legal & Legislative Chair for the Tennessee SHRM State Council.
Luther Wright, Jr. is Of Council with Ogletree Deakins and has significant experience in the areas of labor and employment law, corporate business litigation and complex litigation, including class action and collective action lawsuits. He typically represents management in all forms of employment discrimination litigation, including litigation based on federal anti-discrimination statutes, state statutes and common law, violence in the workplace, Fair Labor Standards Act claims and independent contractor disputes. Luther also devotes a significant amount of his practice to day-to-day client advice and supervisor/employee training.
